Conditions of Use

  1. All charges incurred in connection with your WHY Institute account will be billed to the credit card designated during the registration process for the account. If you want to designate a different card or there is a change in credit card validity or expiration date, or if you believe someone has accessed the site using your username and password without your authorization, you may change your card details by clicking on your name in the top right, go to “Settings” and then click on “Credit Card Info” in the upper right corner of the page.
  2. WHY Institute memberships are billed on a yearly basis and are non-refundable. In order to treat everyone equally, no exceptions will be made.
  3. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
  4. Users are responsible for any incurred foreign transaction fees, user credit card or bank fees, or differences and fluctuations in foreign exchange rates.

  1. You are solely responsible for properly canceling your account by contacting team@whyinstitute.com.
  2. By joining WHY Institute you understand that your membership is a minimum one-year commitment. If you cancel the service before the end of your current paid up year, your cancellation will take effect immediately and you will not be charged again.
  3. WHY Institute, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the WHY Institute IP for any reason at any time. Such termination of the service will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. WHY Institute reserves the right to refuse service to anyone for any reason at any time.

  1. WHY Institute reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice.
  2. WHY Institute shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

This site is owned and operated by WHY Institute. Individual items of information, graphics, software and other material (“content”) accessible through the WHY Institute web site (“site”) may be protected by copyright. You may not copy, download, reproduce, post, transmit, upload, distribute or otherwise publish any content protected by copyright, without first obtaining permission of the copyright owner.

You agree to abide by any and all copyright notices or other restrictions contained in any individual content accessed through this site. The site is copyrighted as a collective work under United States copyright laws. Except as expressly provided for in these conditions of use, you shall not copy, distribute, download, publish or create a derivative work from the Site or any part thereof. All trademarks, service marks, and trade names are proprietary to WHY Institute.

You may download or copy content accessed through the site for personal use provided that you maintain all copyright and other proprietary notices contained in such content. In no event may you, directly or indirectly, sell or offer for sale, upload, distribute, or otherwise publish any content accessed through the site in any form or medium.

Privacy Policy

We primarily use the identification information you voluntarily share with us to customize your online experience and to do what you have asked of us. We also use your identification information to tell you about our products and services, but you may instruct us not to send communications to you by following the procedure indicated below under “Contacting Us.” On occasion, we use your identification information to validate your identity. As for usage tracking data, we primarily use that information to operate and improve our consumer-facing applications and to further our marketing efforts. As a general rule, we do not share your information with unaffiliated third parties. We may, however, share your information with our own personnel and our service providers to the extent necessary to fulfill your requests. We may also share your information with our affiliates, but we will not sell it to or share it with unaffiliated third parties for direct marketing purposes. We reserve the right to disclose your information under limited circumstances, such as to cooperate with law enforcement or judicial authorities as required by law or legal process, to protect our own legal rights, or to protect the public good.

Whenever you are online or on our consumer-facing applications, you run the risk that the information you give out will fall into the wrong hands. Although we implement and maintain commercially reasonable security procedures and practices to safeguard your privacy, we cannot guarantee the security of any information you provide to us. We accept no responsibility or liability for the activities of third parties. By using our consumer-facing applications and other consumer applications, you agree to our Terms of Use.

If you would like to review the information about you that we have collected through our consumer-facing applications or to change that information, you can make that request by following the procedure indicated below under “Contacting Us.” We may require that you verify your identity before we process your request.

Electronic communications such as email, text messages and social media messaging, are neither secure nor confidential. While WHY Institute has adopted policies and procedures to aid in avoiding fraud, even the best security protections can still be bypassed by unauthorized parties. WHY Institute will never send you any electronic communication with instructions to transfer funds or to provide nonpublic personal information, such as credit card or debit numbers or bank account and/or routing numbers.

YOU SHOULD NEVER TRANSMIT NONPUBLIC PERSONAL INFORMATION, SUCH AS CREDIT OR DEBIT CARD NUMBERS OR BANK ACCOUNT OR ROUTING NUMBERS, BY EMAIL OR OTHER UNSECURED ELECTRONIC COMMUNICATION. EMAILS ATTEMPTING TO INDUCE FRAUDULENT WIRE TRANSFERS ARE COMMON AND MAY APPEAR TO COME FROM A TRUSTED SOURCE.

If you receive any electronic communication directing you to transfer funds or provide nonpublic personal information, EVEN IF THAT ELECTRONIC COMMUNICATION APPEARS TO BE FROM WHY Institute or its affiliates, do not respond to it and immediately contact WHY Institute. Such requests, even if they may otherwise appear to be from WHY Institute are likely part of a scheme to defraud you by stealing funds from you or using your identity to commit a crime. To notify WHY Institute of suspected fraud related to your transaction, send an email to team@whyinstitute.com

We may, from time to time, change our Privacy Policy. We will notify you of any changes by posting our updated Privacy Policy on our consumer applications and inserting a new “Effective Date.”

Our consumer applications are hosted by servers in the United States. If you are located outside of the United States, your personal information may be transferred to the United States. By submitting your personal information, you consent to its transfer to the United States and to its storage, processing, and use there in accordance with this Privacy Policy.

Refund Policy

The WHY Institute® will not accept refund requests for any unused WHY Agent Certification online course work and online WHY Discovery Codes purchased directly from WHY Institute®. For further inquiry please email team@whyinstitute.com and provide the following information: purchaser name, email address, and date of purchase.

Privacy Policy

To provide the Live Your WHY.os experience, we collect information you choose to share with us, information generated while using the app, and limited technical information that helps us operate, improve, and secure the service.

Account Information

When you create an account, we collect information such as:

  • Your email address
  • The name you’d like us to call you (your display name)
  • Your encrypted login credentials
  • Your time zone
  • An optional profile photo
  • Your WHY.os profile, including your WHY, HOW, WHAT, and archetypes

Daily Check-Ins, Today & Journal Entries

If you choose to use the daily reflection features, we collect the information you enter, including:

  • Daily check-ins
  • Your Today reflections and daily actions (“moves”)
  • Journal entries
  • Alignment ratings
  • Personal notes and reflections

Some of this information may be personal or sensitive depending on what you choose to write.

Your journal entries, Today reflections, and daily check-ins are private by default. They are visible only to you unless you intentionally choose to share content through the community features of the app.

We store this information so you can revisit your entries over time, track your progress, and continue your personal growth journey within Live Your WHY.os. Your personal reflections belong to you.

You may edit or delete your journal entries and other personal reflections at any time within the app. If you would like us to remove all of your personal information, you may request deletion of your account by contacting us at team@whyinstitute.com.

Ask Gary

When you interact with Ask Gary, we collect the messages you send and the responses generated in order to provide the feature you requested.

Community Activity

If you participate in the Live Your WHY.os community, we collect information related to your activity, including:

  • Posts you publish
  • Comments
  • Reactions
  • People you choose to follow
  • Content you report

You control what you choose to share with the community and may remove your own posts and comments at any time.

Feedback

If you contact us, submit feedback, or report a problem, we collect the information you provide so we can respond and improve the app.

Technical Information

Like most online services, we automatically collect limited technical information to help operate, secure, and improve the app. This may include your device type, browser type, IP address, operating system, app usage, diagnostic information, and similar technical data.

We may also use analytics tools to better understand how people use the app so we can improve its performance and user experience. The analytics providers we use may change over time as the app evolves.

We use the information we collect to provide, maintain, and improve the Live Your WHY.os experience. Our goal is to help you stay connected to your WHY.os while giving you a secure and personalized experience.

We may use your information to:

  • Create and manage your account.
  • Save your daily journal entries, check-ins, and progress.
  • Personalize your daily experience based on your WHY.os profile.
  • Generate responses and guidance through Ask Gary.
  • Provide community features and display the content you choose to share.
  • Respond to questions, feedback, and support requests.
  • Maintain the security, reliability, and performance of the app.
  • Monitor usage trends to improve existing features and develop new ones.
  • Send important service-related communications, such as account updates, security notices, and changes to the app or this Privacy Policy.

From time to time, we may introduce optional features such as reminders, push notifications, or weekly summaries. If these features become available, you will be able to manage your notification preferences within the app.

We do not sell your personal information. We also do not use your journal entries, reflections, or conversations with Ask Gary for advertising or cross-context behavioral advertising.

Live Your WHY.os includes AI-powered features, including Ask Gary, designed to help you better understand and apply your WHY.os in everyday life.

When you use Ask Gary, the information you choose to share may be processed by our AI service provider, Anthropic, solely to generate the responses and guidance you request. We share only the information necessary to provide the feature.

We do not use your conversations with Ask Gary for advertising purposes. Our AI providers process information on our behalf under agreements designed to protect your privacy and confidentiality.

Ask Gary is intended to provide educational guidance, personal development support, and encouragement based on the WHY.os framework. While we strive to provide helpful and accurate responses, AI-generated content may occasionally contain inaccuracies or incomplete information.

Ask Gary is not a substitute for professional advice. It is not intended to provide medical, mental health, psychological, legal, financial, or other professional advice or services.

If you are experiencing a medical emergency, mental health crisis, or believe you may be in immediate danger, do not rely on the app or Ask Gary. Please contact your local emergency services or the appropriate crisis resources available in your area.

As our AI features continue to evolve, we may introduce new capabilities or improve existing ones. If these changes affect how your information is processed, we will update this Privacy Policy accordingly.

Live Your WHY.os includes community features that allow members to encourage, learn from, and support one another as they live out their WHY.os.

If you choose to participate in the community, you control what you share. Community content may include:

  • Posts you publish
  • Comments you leave
  • Reactions to other members’ posts
  • People you choose to follow

When creating your account, you choose the name you’d like other members to see. This display name does not have to be your legal name.

Some community features may also allow you to participate anonymously. When you choose to post anonymously, your identity will not be displayed to other community members.

You may edit or delete your own posts and comments at any time. Removing content from the community removes it from public view, although limited information may be temporarily retained in secure backups or where required for legal, security, or abuse prevention purposes.

Please remember that anything you choose to share publicly within the community may be viewed by other members. We encourage you to avoid posting information you would not want others to see.

We reserve the right to remove content that violates our Community Guidelines or Terms of Service in order to maintain a safe, respectful, and supportive environment for everyone.

We believe your personal information belongs to you. We do not sell your personal information, and we do not share your journal entries, reflections, or conversations with Ask Gary for advertising or cross-context behavioral advertising.

We only share information when it is necessary to operate the Live Your WHY.os app, provide the services you request, comply with legal obligations, or protect the security of our users and business.

Service Providers

We work with carefully selected service providers who help us operate the app. These providers are contractually required to protect your information and may only use it to provide services on our behalf.

Our current service providers may include:

  • Anthropic – AI processing for Ask Gary and other AI-powered features.
  • Supabase – Secure database, authentication, and data storage.
  • Render – Hosting and application infrastructure.
  • Resend – Transactional emails such as account verification and password reset emails.
  • Analytics providers that help us understand app performance and improve the user experience.

As our platform evolves, we may add or replace service providers. We will update this Privacy Policy as appropriate.

Legal Requirements

We may disclose information if required by law, court order, subpoena, or other valid legal process, or when we believe disclosure is reasonably necessary to protect the rights, safety, property, or security of our users, WHY Institute, or others.

Business Changes

If WHY Institute is involved in a merger, acquisition, sale of assets, or other business transaction, your information may be transferred as part of that transaction. If that happens, we will take reasonable steps to ensure your information continues to be protected and will notify users if required by applicable law.

Managing Your Information

Your personal reflections belong to you. You are always in control of the journal entries, daily check-ins, Today reflections, and other content you choose to create within the app.

You can manage much of your information directly within the app, including editing or deleting your journal entries and reflections. If you would like us to remove your account or any personal information we maintain about you, simply email us at team@whyinstitute.com. We will process verified requests in accordance with applicable law.

We may ask you to verify your identity before fulfilling certain requests in order to protect your privacy and security.

Deleting Your Account

You may request deletion of your account at any time. When we receive a verified request, we will delete or anonymize your personal information in accordance with applicable law and our data retention practices. Certain information may be retained for a limited period where necessary for legal compliance, fraud prevention, security, backup restoration, or other legitimate business purposes.

State Privacy Rights

If you live in a state with applicable privacy laws, including California, Colorado, Connecticut, Virginia, Texas, Oregon, Washington, and other states with comprehensive privacy legislation, you may have additional rights regarding your personal information. We will honor those rights as required by applicable law.

While we work hard to protect your information, no website, mobile application, or online service can guarantee absolute security. We encourage you to choose a strong password and keep your login credentials confidential.

How Long We Keep Your Information

We retain your information for as long as your account remains active or as long as necessary to provide the services you request.

You may edit or delete individual journal entries and other content you create within the app. If you choose to delete your account, we will delete or anonymize your personal information in accordance with applicable law and our data retention practices.

In some situations, we may retain limited information for a reasonable period of time to comply with legal obligations, resolve disputes, prevent fraud, enforce our agreements, maintain secure backups, or protect the security and integrity of our services.

When information is no longer needed for these purposes, it is securely deleted or anonymized.

Live Your WHY.os is intended for individuals who are 16 years of age or older. We do not knowingly collect personal information from anyone under the age of 16.

If we learn that we have collected personal information from someone under 16 without appropriate authorization where required by law, we will take reasonable steps to delete that information as quickly as possible.

International Users

Live Your WHY.os is operated from the United States. If you access the app from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country.

By using the app, you acknowledge and consent to this transfer where permitted by applicable law.

As Live Your WHY.os continues to grow, we may update this Privacy Policy from time to time to reflect changes in our services, technology, legal requirements, or business practices.

When we make material changes, we will update the Effective Date at the top of this policy and, where required by law, provide additional notice through the app or by email.
